1. About these Terms
These Terms govern:
- use of the HAZO WORLD website, configurators and online project tools; and
- quotations, custom-made goods, supply-only orders, delivery and related product support supplied by HAZO WORLD PTY LTD (HAZO, we, us or our).
Additional written terms may apply to a particular product or project. If documents are inconsistent, the following order applies to the extent of the inconsistency:
- the current Formal Quote and its identified schedules;
- an order-specific product, warranty or delivery schedule;
- these Terms; and
- general website information.
Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law (ACL).
2. Key definitions
Customer means the person or entity named in a Formal Quote or using the website.
Consumer has the meaning given by the ACL.
Design & Price means the website’s guided product-selection and estimate process.
HAZO Project means a draft collection of product configurations saved in the user’s current browser unless and until it is submitted through the identified Formal Quote Request process.
Technical Review means HAZO’s review of submitted configuration and project information for quoting. It is not structural engineering, site certification or installation approval.
Formal Quote means the written quotation issued by HAZO for an identified customer and project.
Formal Order means HAZO’s written confirmation that the current Formal Quote has passed the stated payment and acceptance requirements and has become an order.
Goods means products, components and accessories identified in a Formal Quote.
Supply Only means HAZO supplies the Goods but does not provide site measurement, structural design, permits, electrical work, lifting, fixing or installation unless the Formal Quote expressly includes a specific service.
3. Website information and estimates
Website content, product images, videos, dimensions, ranges, lead-time guidance and estimated prices are general information. They help a Customer explore a project but are not a Formal Quote, an offer capable of acceptance, engineering advice, installation instructions or a promise that a particular combination is available.
Configurator prices are estimates based on the selections and information entered. Freight, access, lifting, project-specific engineering, unusual finishes and other project requirements may be confirmed separately in the Formal Quote.
The Customer must check the Formal Quote rather than relying on an earlier screen, PDF, saved browser draft, verbal discussion or marketing image.
4. HAZO Projects and submissions
Before submission, a HAZO Project is normally stored only in the current browser on the current device. It may be lost if browser data is cleared and may not appear on another device. A browser reference number does not mean the project has been submitted, checked, quoted, ordered, paid or released for production.
A Product Enquiry is an early-stage request for help choosing a product. It sends the customer’s contact details, product interest and message, but does not submit a saved HAZO Project for final review. HAZO may respond by sending the most suitable configurator link or requesting more information.
A Formal Quote Request is a separate submission made after the Customer has configured and reviewed one or more products. It sends the saved configurations, selected options, estimated prices and review notes to HAZO for Technical Review. HAZO is not required to issue a Formal Quote for every request and may decline a project it cannot responsibly supply.
5. Customer information and site responsibility
The Customer must provide complete and accurate information relevant to the project, including:
- intended product and quantity;
- finished dimensions or the dimensions requested by the configurator;
- delivery address, postcode, access and unloading constraints;
- fixing surface, supporting structure and known obstructions;
- relevant wind, exposure, drainage, electrical and compliance conditions; and
- details of the builder, installer or electrician where reasonably requested.
Unless expressly included in the Formal Quote, the Customer is responsible for engaging competent people to confirm site measurements, structural adequacy, fixings, permits, building and planning requirements, electrical work, lifting, access and installation.
HAZO’s Technical Review checks the proposed product configuration against the information provided. It does not replace an on-site inspection, structural engineer, certifier, licensed electrician or qualified installer.
6. Formal Quotes
A Formal Quote identifies the Goods, selected options, price, GST treatment, freight or collection arrangement, expected timing, payment requirements, exclusions and the documents incorporated into that quote.
Unless the Formal Quote states another period, it expires at the end of the date printed on the Formal Quote, normally 14 calendar days after its issue date. After expiry, HAZO may recheck price, availability, freight and lead time and issue a new quote. A payment made against an expired or superseded quote does not by itself create a Formal Order.
The Customer must review every item before proceeding, including product identity, finished dimensions, colours, fabrics, operation, motor, controls, sensors, lighting, quantities, included accessories, delivery details and exclusions. HAZO may correct an obvious clerical or calculation error before a Formal Order is formed.
7. Formation of a Formal Order
An enquiry, website estimate, HAZO Project, Technical Review, Formal Quote, receipt or Tax Invoice is not a Formal Order.
Unless the Formal Quote states an approved alternative, a Formal Order is formed only when both of the following have occurred:
- HAZO has verified exact full cleared payment that accurately matches the current Formal Quote; and
- HAZO has issued a separate written Formal Order Confirmation identifying that quote and project.
HAZO’s accounting system may issue a receipt or Tax Invoice after payment is verified. That accounting document records the financial transaction but is not, by itself, the Formal Order Confirmation. If payment is incomplete, cannot be matched, or relates to an expired or superseded quote, HAZO may hold or return the funds while the matter is clarified and will not release the project to production merely because money was received.
8. Prices, GST and payment
Prices are in Australian dollars and include GST unless the Formal Quote states otherwise. Freight, specialist carrier, lifting, restricted-access, storage or re-delivery costs are included only where stated.
The Customer must use the payment method and reference in the Formal Quote. The Customer is responsible for bank charges or payment errors caused by its chosen payment method. HAZO will never ask the Customer to rely solely on changed bank details in an unexpected email; the Customer should independently verify any requested change using HAZO’s published contact details.
9. Custom-made Goods and changes
Most HAZO Goods are produced to the approved dimensions, colours and options for one project. Once a Formal Order is issued, HAZO may commit materials, component allocation, technical work and production capacity.
The Customer must request any change in writing immediately. A requested change is not accepted unless HAZO confirms it in writing. HAZO may decline the change or issue a revised Formal Quote covering reasonable additional cost, waste, freight and delay.
HAZO does not offer a voluntary change-of-mind cancellation or return for custom-made Goods. HAZO may, but is not obliged to, consider a written cancellation request before manufacture is complete and may require payment of reasonable, evidenced costs already committed. This does not limit rights relating to faulty, unsafe, misdescribed or incorrectly supplied Goods under the ACL.
10. Product specifications and reasonable variation
Colours, textures and finishes shown on screens, printed samples and photographs can vary because of lighting, display settings, material batches and normal manufacturing tolerances. Samples are a guide unless the Formal Quote identifies an approved control sample.
HAZO will not substitute a different material, brand or material specification that materially affects the agreed product without the Customer’s written approval. Minor production changes that do not reduce the agreed function, safety, appearance or warranty may be notified where reasonably relevant.
11. Lead times and progress visibility
Lead times are planning estimates, not guaranteed delivery dates, unless HAZO expressly agrees to a fixed date in writing. Timing may be affected by final approvals, material availability, production sequencing, quality checks, transport, port or customs events, weather, access and events outside reasonable control.
HAZO will record and communicate material order stages through the available order communication process or Order Portal. If a material delay becomes known, HAZO will provide the information reasonably available and the next expected step.
12. Delivery, collection and site access
The Formal Quote will state the delivery or collection basis. The Customer must ensure that the address, receiving contact, access information and delivery restrictions are accurate.
Long, heavy or oversized Goods may require a specialist carrier, safe vehicle access, unloading equipment, people to receive the Goods, or delivery to an alternative depot or collection point. HAZO will identify known additional cost or inability to reach the requested address before Formal Order confirmation where the relevant information has been provided.
Unless the Formal Quote includes another service, delivery is to the practical carrier-accessible location and does not include moving Goods through a building, to a backyard, onto a roof or into final installation position.
If delivery cannot be completed because the Customer or site is not ready, reasonable storage, waiting, return, re-delivery or alternative delivery costs may be payable after HAZO explains the proposed cost.
The Customer should count, inspect and photograph packages before they are moved or installed. Damage, missing packages or an incorrect delivery should be reported promptly with the order reference and evidence. Prompt notice helps preserve freight evidence, but does not remove rights that cannot lawfully be excluded.
13. Risk and title
Subject to rights under the ACL, risk of accidental loss or damage passes when the Goods are delivered to the agreed location or collected by the Customer or its nominated carrier. Legal title passes when HAZO has received full cleared payment and the Goods have been delivered or collected, whichever occurs later.
The Customer must keep uninstalled Goods dry, secure, correctly supported and protected in accordance with the supplied instructions.
14. Installation and third-party work
Unless a Formal Quote expressly includes installation by an identified party, HAZO is a Supply Only seller. The Customer chooses and contracts with its installer, builder, engineer, electrician, crane or lifting provider.
HAZO is not responsible for independent work that it did not supply or control. This includes incorrect site measurements, unsuitable structure, fixings, waterproofing, electrical connection, permits, access, lifting, installation or unauthorised modification. This does not exclude HAZO’s responsibility for the Goods or services that HAZO actually supplies, or any non-excludable legal rights.
15. Warranty, returns and remedies
The warranty periods and component boundaries applying to a Formal Order are identified in its warranty schedule or supplied warranty document. Different terms may apply to the frame, mechanism, coating, fabric, motor, controls, sensors and lighting.
The HAZO WORLD Warranty & Returns Policy explains the support request process, custom-order position and warranty periods. Manufacturer warranties are additional to, and do not replace, rights under the ACL.
HAZO does not require a Customer to accept store credit for a faulty product where another remedy is required by law. The available remedy depends on the facts and whether any failure is major or minor.
16. Non-custom stock returns
HAZO does not offer a voluntary change-of-mind return for non-custom or stock Goods. Customers should confirm suitability before a Formal Order is formed.
This position does not limit rights or remedies for Goods that are faulty, unsafe, misdescribed, incorrectly supplied or otherwise fail an applicable consumer guarantee under the ACL.
17. Events outside reasonable control
Neither party is responsible for delay caused by an event it could not reasonably prevent or overcome. The affected party must notify the other as soon as reasonably practicable and take reasonable steps to reduce the effect.
If such an event materially prevents HAZO from supplying for an extended period, HAZO will discuss available options, which may include a revised timetable, agreed alternative, pause or cancellation with an appropriate adjustment for Goods and work already reasonably committed. This clause does not remove non-excludable rights.
18. Liability
Nothing in these Terms excludes, restricts or modifies a guarantee, right, remedy or liability that cannot lawfully be excluded, including under the ACL.
To the maximum extent permitted by law, HAZO is not liable for loss caused by inaccurate or incomplete Customer information, site conditions not disclosed to HAZO, work or components not supplied or controlled by HAZO, unauthorised modification, or failure to follow supplied storage, use and maintenance instructions. HAZO is not liable for remote or indirect loss that was not reasonably foreseeable.
Where the law permits a remedy to be limited, HAZO may limit its liability to repairing or replacing the relevant Goods, resupplying the relevant services, or paying the reasonable cost of doing so. This limitation does not apply where it would be unlawful or where a broader remedy is required by the ACL.
19. Disputes
The Customer should first contact HAZO with the order or quote reference, the outcome sought and supporting information. HAZO will review the matter and respond in good faith.
If the matter is not resolved, either party may use an applicable state or territory fair trading service, tribunal or court. Nothing in this section prevents urgent action or the exercise of a statutory right.
20. Privacy
HAZO handles personal information in accordance with its Privacy Policy. Project details may need to be shared with manufacturing, component, freight, IT and professional service providers to prepare and fulfil a Formal Order. The Privacy Policy explains the purposes, safeguards, overseas disclosures and access or complaint process.
21. Website use and intellectual property
The website and its text, graphics, configuration logic, product models, trade marks and other content are owned by or licensed to HAZO. The Customer may use the website for genuine project evaluation and may retain its own project outputs. No person may copy, scrape, reverse engineer, republish or commercially exploit the website or its models without written permission, except where the law permits.
The Customer must not interfere with the website, introduce malicious code, attempt unauthorised access or use automated processes that unreasonably burden the service.
Third-party links are provided for convenience. HAZO does not control a third-party site and its terms and privacy practices may differ.
22. Changes to these Terms
The version applying to a Formal Order is the version incorporated into or supplied with the current Formal Quote when the order is formed. A later website update does not retrospectively alter an existing Formal Order unless both parties agree in writing or the law requires the change.
HAZO may update the website-use portions of these Terms prospectively. The effective date and version will be shown at the top of the published document.
23. Governing law
These Terms are governed by the laws of New South Wales and applicable Commonwealth laws. The parties submit to the non-exclusive jurisdiction of courts and tribunals with authority in New South Wales. Consumer rights available in another Australian jurisdiction are not excluded.
